1PAGE TEN RESOLUTION No. 308 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF AVALON, ORDERING CERTAIN STREET WORK TO BE DONE ON A PORTION OF MARILLA AVENUE IN THE CITY OF AV- ALON, STATE OF CALIFORNIA, AS CONTEMPLATED BY RESO- LUTION OF INTENTION No. 278 OF SAID CITY, AND DETER- MINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREOF The Board of Trustees of the City of Avalon do resolve as follows: SECTION 1: That the street work herein described is required by the public interest and convenience, and the Board of Trustees of the City of Avalon, State of California, hereby or- ders the same to be done according to the specifications and plans adopted for said work and under the direction of and to "the satisfaction of the Su- perintendent of Streets of said City of Avalon, to-wit : FIRST: All that portion of the roadway of Marilla Avenue between a line drawn across said Marilla Avenue distant ten (10) feet Southwesterly from and parallel with the Northeast- erly line of Lot Thirty-eight (38), Block Thirty-three(33), of the Town of Avalon, as per map of said town re- corded in Beok Thirty-four (34), Page Sixty-seven (67) et seq., Miscellaneous Records of Los Angeles County, Cali- fornia, prolonged Northwesterly across said Maritla Avenue, and the South- westerly line of Lot Forty-five (45), said Block Thirty-three (33), Town of Avalon, prolonged Northwesterly across said M~/rilla Avenue, be graded to the ' official grade in accordance with plans, profiles and cross-sections number 107- B, and in further accordance with spe- cial specifications therefor, adopted by the Board of Trustees of the City of Avalon by Resolution No. 277 on file in the office of the City Clerk of the City of Avalon. SECOND: That a cement curb be constructed along both lines of the roadway of said Marilla Avenue be- tween a line drawn across said Marilla Avenue distant ten (10) feet South- westerly from and parallel with the Northeasterly line of Lot Thirty-eight (38), Block Thirty-three (33), of Town of Avalon, as per map of said town recorded in Book Thirty-four (34) Page Sixty-seven (67), et seq,, Mis- cellaneous Records of Los Angeles County, California, prolonged North- westerly across said Marilla Avenue and the Southwesterly line of Lot For- ty-five (45), Block Thirty-three (33), Town of Avalon prolonged Northwest- erly across said Marilla Avenue, in accordance with plans, profiles and cross-sections number 107-]3, and in further accordance with special spe- cications therefor, adopted by the Board of Trustees of said City of Av- alon by Resolution No. 277 on file in the office of the City Clerk of said City of Avalon. THIRD: That a cement side- walk five (5) feet in width be constructed along theSoutheasterly line of Marilla Avenue from a line drawn across said Marilla Avenue distant ten (10) feet South- westerly from and parallel with the Northeasterly line of Lot Thirty-eight (38), in said Block Thirty-three (33), of Town of Avalon, as per map recorded in Book Thirty-four(34) Page Sixty-seven (67), et seq., Mis- cellaneous Records of Los Angeles County, California, prolonged North- westerly across said Marilla Avenue and the Southwesterly line of Lot For- ty-five (45), said Block Thirty-three (33), of Town of Avalon, prolonged Northwesterly across said Marilla Ave- nue, in accordance with plans, profiles and cross-sections number 107-B, and in furtfier accordance with special spe- cifications therefor adopted by the Board of Trustees of said City of Av- alon by Resolution No. 277 on file in the office of the City Clerk of said City of Avalon, and said cement side- walk shall be located with the inner edge thereof two (2) feet Northwest- erly from and parallel with the adja- gent property line. FOURTH: That a cement gutter two (2) feet in width be constructed - r,,, ?, i, , ,, f ,, , , ,, ,, along both lines of the roadway of said Marilla Avenue between a line drawn across said Marilla Avenue distant ten (10) feet South- westerly from and parallel with the Northeasterly line of Lot Thirty-eight (38), Block Thirty-three (33), of Town of Avalon, as per map recorded in Book Thirty-four (34) Page Sixty- seven (67), et seq., Miscellaneous Records of Los Angeles County, California, prolonged Northwesterly across said Marilla Avenue and the Southwesterly line of Lot For- ty-five (45), said Block Thirty-three (33), of Town of Avalon, prolonged Northwesterly across said Marilla Ave- nue, in accordance with plans, profiles and cross-sections number 107-B, and in further accordance with special spe- cications therefor, adopted by the Board of Trustees of the City of Av- alon by Resolution No. 277 on file in the office of the City Clerk of the said City of Avalon. FIFTH: That a wood bulkhead be constructed along the South-" easterly line of Marilla Avenue be- tween a line drawn across said Marilla Avenue distant ten (10) feet South- westerly from and parallel with the Northeasterly line of Lot Thirty-eight (38), Block Thirty-three (33), of Town of Avalon, as per map recorded in Book Thirty-four (34) Page Sixty-seven (67), et seq., Mis- cellaneous Records of Los Angeles County, California, prolonged North- westerly across said Marilla Avenue and the Southwesterly line of Lot For- ty-five (45), said Block Thirty-three (33), of Town of Avalon, prolonged Northwesterly across said Marilla Ave- nue, in accordance with plans, profiles and cross-sections number 107-B, and in further accordance with special spe- cications therefor, adopted by the Board of Trustees of the City of Av- alon by Resolution No. 277 on file in the office of the City Clerk of said City of Avalon. SECTION 2: All plans, profiles and cross-sections referred to in this Res- olution are on file in the office of the City Engineer of said City. All special specifications referred to in this Resolution are on file in the office of the City Clerk of said City of Avalon All special specifications, plans, pro- files and cross-sections referred to in this Resolution were adopted for said work by Resolution No. 277 of the Board of Trustees of the City of Ava- lon, State of California, on file in the office of the City Clerk of said City. That the diagram or map indicating the boundary lines and the extent of the territory to be included in this as- sessment district, prepared by the City Engineer in accordance with Resolu- tion of Intention No. 278 of the Board of Trustees of the City of Avalon, on file in the office of the City Engineer of said City, is on file in the office of the City Engineer of said City of Av- al6n. All of the plans, profiles, cross-sec- tions, special specifications, maps and resolutions herein above referred to are made a part hereof and expressly referred to herein for a more particu- lar description of said work. SECTION 3: The Board of Trus- tees of the City of Avalon determines that serial bonds shall he issued to represent assessments of Twenty-five ($25.00) Dollars or over for the cost of said work or improvement; said serial bonds shall extend over a period ending nine (9) years from and after the second day of January next suc- ceeding the date of said bonds, and an even annual proportion of the princi- pal sum thereof shall be payable, by Coupon, on the second day' of January every year after their date until the whole is paid; and the interest shall be payable semi-annually, by coupon, on the second days of Janu- ary and July, respectively, of each year, at the rate of seven (7) per cent per annum on all sums unpaid, until the whole of said principal and inter- est are paid. Said bonds shall be is- sued in accordance with the provisions of an Act of the Legislature of the State of California, entitled, "An Act to provide a system of street improve- ment bonds to represent certain as- sessments for the cost of street work and improvement within municipali- ties, and also for the payment of such bonds," approved February 27, 1893, and of all Acts supplementary thereto or amendatory thereof. SECTION 4: The Catalina Islander, a weekly newspaper of general circu- lation, published and circulated in said City of Avalon, is hereby designated as the newspaper in which this Reso- lution and notice of said work, invit- ing sealed proposals, shall be published in the manner and form and by the persons required by law. SECTION 5: The City Clerk of the City of Avalon is hereby directed to post conspicuously for five (5) days on or near the chamber door of the Board of Trustees, in the manner and form required by taw, a notice with specifi- cations, inviting sealed proposals or bids for doing said work; and said City Clerk is hereby directed to pub- lish for two (2) days in said newspa- per hereby designated as aforesaid in the manner and in the form required by law, a notice of said work im, iting sealed proposals or bids for doing said work and referring to specifications posted or on file. "Said notice shall re- quire a certified check or bond or ei- ther as prescribed by law for an amount not less than ten (10) percent of the aggregate of the proposal. Said City Clerk is also directed to publish this Resolution for two days in the manner required by law in said news- paper designated for that purpose as aforesaid.
