CITY OF AVALON ORDINANCE SUMMARY NOTICE IS HEREBY GIVEN .that on November 7, 2017, the Avalon City Council will consider adopting the following entitled ordinance: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AVALON CALIFORNIA, AMENDING TITLE 5 OF THE AVALON CITY MUNICIPAL CODE TO ADD A NEW CHAPTER 30 ENTITLED "PERSONAL CANNABIS CULTIVATION REGULATIONS" If adopted, the Ordinance would permit personal indoor and outdoor cannabis cultivation of up to six cannabis plants consistent with that allowed'by the Medicinal and Adult-Use Cannabis Regulation and Safety Act ("MAUCURSA"). The Ordinance also adds a number of regulations on where and how cultivation may take place, including the following provisions for outdoor cultivation: Outdoor personal cultivation of cannabis is only permitted in a rear yard that is entirely enclosed by a lockable, solid, opaque fence that is associated with a dwelling or secondary dwelling unit. The height of the cannabis plants shall not exceed the standard fence height applicable to the parcel, or six (6) feet, whichever is lesser. The cannabis plants shall be placed at a minimum setback of three (3) feet from the edge of the canopy to the property line. No exterior evidence of cannabis cultivation occurring at the property shall be visible from the public right-of-way. For persons other than qualified patients or primary caregivers, all outdoor personal cultivation shall be conducted by persons twenty-one (21) years of age or older, and the cumulative total of cannabis plants on the property, indoor or outdoor, shall not exceed six (6) cannabis plants, regardless of the number of persons residing on the property. For qualified patients and primary caregivers, the cumulative total of cannabis plants outside shall not exceed six (6) cannabis plants, regardless of the number of qualified patients and primary caregivers residing on the property. Any residential property used for outdoor cultivation of cannabis must take reasonable measures to prevent cannabis plant odors or particles from becoming a public nuisance to surrounding properties or the public. A public nuisance may be deemed to exist if the cultivation produces odors which are disturbing to people of normal sensitivity residing or present on adjacent or nearby property or areas open to the public. With respect to indoor cultivation, the proposed Ordinance wo ld require thefollowing: Cannabis cultivation is permitted only within fully enclosed and secure structures inaccessible to minors. Only one cultivation area per a residence is allowed. Cannabis cultivation areas shall not be accessible to persons under 21 years of age. Cultivation areas shall be secured by lock and key or other security device which prevents unauthorized entry. Indoor cultivation of cannabis shall not exceed twenty-five (25) square feet, unless authorized by the Sherriff as part of a request for cultivation for medical necessity. Cannabis cultivation lighting shall not exceed one thousand two hundred (1,200) watts and shall be shielded to confine light and glare to the interior of the allowable structure. All lighting use in the cultivation of cannabis shall comply with the City's Building Regulations as codified in Title 8 of the Avalon Municipal Code. The use of gas products (CO2, butane, etc.) or generators for cannabis cultivation or processing is prohibited. From a public right-of-way, there shall be no exterior evidence of cannabis cultivation. The residence shall be occupied and is required to maintain a functioning kitchen and bathroom(s), and the use of primary bedrooms are for their intended purpose. Those rooms shall not be used for cannabis cultivation. Any cannabis cultivation area located within a residence shall not create a humidity or mold problem in violation of City's Building Regulations as codified in Title 8 oftheAvalon Municipal Code or the Health and Safety Code. Any residence used for the cultivation of cannabis must have proper ventilation to prevent mold damage and to prevent cannabis plant odors or panicles from becoming a public nuisance to surrounding properties or the public. A public nuisance may be deemed to exist if the cultivation produces odors which are disturbing to people of normal sensitivity residing or present on adjacent or nearby properties dr areas open to the public. The above summary constitutes the major highlights of the proposed ordinance. A reading of the entire ordinance may be necessary to obtain a full understanding of the ordinance. I With Capt. John Hocking Editor's note: The following is the Avalon Sheriff's Station significant incidents report for the week of Oct. 18 to Oct. 24. All suspects are presumed innocent until proven guilty in a court of law. Many people who are arrested do not get prosecuted in the first place and many who are prosecuted do not get convicted. Capt. John Hocking Station commander Thursday, October 18 Deputies investigated an incident in which several sus- pects used stolen credit cards online to rent properties in the city of Avalon. Deputies have identified two possible suspects. The detectives are continuing with the investigation. Friday, October 19 Deputies responded to a call of a family dispute on the 300 block of Sumner Avenue. Upon their arrival, the deputies learned the suspect had assaulted the victim and broke a window to the residence. The investigation is ongoing. Saturday, October 20 Deputies received a call of a motorist driving recklessly on Pebbly Beach Road near Lover's Cove. ~,.. Deputies stopped several golf carts in the area for driving over the speed limit. Sunday, October 21 Deputies arrested Patricia Nava of Monterey Park on suspicion of spousal assault in the 100 block of Sumner Avenue. Nava report- edly assaulted her live- in boyfriend, ultimately sending him to the hos- pital. Monday, October 22 Based on an out- standing "no bail" war- rant deputies arrested Isaac Rios of Avalon on suspi- cion of vehicle theft at Sumner Avenue and Tremont Street. Rios also had a $40,000 traffic warrant. He was arrested based on both warrants. Tuesday, October 23 Deputies from Avalon Sheriff's Station participated in the Red Ribbon Week at the Avalon School. Red Ribbon Week is to educate children to not use illegal drugs. The Sheriff's Department is working with our community leaders to keep our children safe. Wednesday, October 24 Deputies issued a citation to Raul Flores from Avalon on suspicion of smoking marijuana in a public place in the 100 block of Catalina Avenue. Flores will have to appear in court in the near future. Safety Note Remember: It is illegal to ride an off-road unregistered mini- bike/motorcycle on the streets of Avalon. Also, do not park in any red marked fire lanes. Both of these offenses may result in cita- tions being issued.
