AN ORDINANCE OF THE CITY OF AVALON REGULATING THE ACCUMULATION, COLLECTION AND DISPOSAL OF GARBAGE, RUBBISH, WASTE AND REFUSE. PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF AN D REPEALING ALL CON- F L I C T I N G ORDINANCES OR PART,~ THEREOF. The City Council of the City of Avalon. does hereby ordain as fol- lows: SECTION 1: For the purpose of this Ordinance, certain words and phrases are defined and certain pro- visions shall be construed as herein set forth, unless it is apparent from the context that a different meaning is intended. The inclusion of specific items in any definition shall not operate to exclude any other items of a similar nature. }~]~CTION 2: "Garbage" includes all i:h~onsumed animal and vege- table ffl~atter incident to the prepa- ration or handling of food. SECTION 3: "Rubbish" includes such combustible material as may be placed in a container which, when filled, will not exceed 75 pounds in weight, including dis- carded cloth or articles~ of clothing, papers, paper bags, treated or un- treated paper, cardboard, fiber or SECTION 13: Any establishment. where rubbish and waste accum- lates, shall have at least 2 additional containers, one for rubbish only and the other for waste only, which. when filled, shall each not exceed 75 pounds in weight. Such rubbish and waste containers need not have covers as provided for in Section 12 hereof, but shall be provided with bales or handles. SECTION 14: Any commercial establishment having a large num- ber of paste board or corrugated paper boxes, shall break them up and place them in the containers herein specified. SECTION 15: The City of A.valon will place at certain locations which they deem necessary trash contain- ers for the use of the general pub- lic. No person shall use such public trash containers for thb disposal of garbage as defined in this ordin- ance. No person having the control of garbage, rubbish of waste con- tainers shall place the same outside for dollection "more than 12 hours prior to the day of collection. SECTION 20: This ordinance is hereby declared to be an urgency measure necessary for immediate preservation of the public peace, health and. safety and it shall take effect and be in force from and af- ter its passage as required by law.
